Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and DPA Tech Solutions SRL ("WhereU", "we", "us"), governing your access to and use of the WhereU mobile and web applications, whereu.fun, and all associated APIs and services (collectively, the "Service"). By creating an account, browsing, or using the Service, you accept and agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years of age and possess full legal capacity to enter into a binding agreement. Age-restricted venues or specific ticketed events may enforce higher minimum age requirements (such as 18+) as specified at checkout.

2. Your Account & Security

You are responsible for maintaining the confidentiality of your authentication credentials and for all activities that occur under your account. Notify us immediately at support@whereu.fun if you detect unauthorized access. You may permanently delete your account and all associated data at any time from whereu.fun/data-deletion.

3. Acceptable Use & Community Standards

  • No harassment, stalking, hate speech, bullying, doxxing, or threats of violence.
  • No posting, transmitting, or generating content that promotes self-harm or suicide.
  • No deceptive accounts, automated data scraping, or bulk API extraction.
  • No unauthorized sharing of another person's private location, images, or personal contact info.
  • No fraudulent transactions, spamming, or tampering with technical security measures.
  • Event hosts are solely responsible for ensuring their events comply with applicable local laws, safety ordinances, ticketing terms, and tax obligations.

4. Paid Features, Subscriptions & Click-to-Cancel Rights

WhereU offers optional paid services, including WhereU PRO, host subscriptions, promoted event boosts, and event ticket purchases:

  • Transparent Pricing: All fees, billing intervals, currencies, and applicable taxes are clearly disclosed prior to payment confirmation.
  • Payment Processing: Payments are handled securely via Stripe. WhereU does not store or process complete credit card details.
  • Automatic Renewal & Frictionless 1-Click Cancellation: Recurring subscriptions automatically renew at the end of each billing cycle (monthly or yearly) at the stated rate. You can cancel your subscription at any time with a single click via your Billing Dashboard or the integrated Stripe Customer Portal. Cancellation takes effect at the conclusion of the current billing period with zero penalties or cancellation fees.
  • Event Tickets: Tickets are purchased directly from independent event hosts. Refund and exchange policies are determined by the respective event organizer and displayed on the event page.
  • Statutory EU Withdrawal Rights: European Union consumers have the right to withdraw from digital purchases within 14 days, subject to standard statutory exceptions once digital performance has commenced with explicit prior consent.

5. Artificial Intelligence & Automated Tools

WhereU provides AI-assisted features (such as weekly check-in summaries and MCP agent integrations). You agree not to abuse AI systems to generate defamatory, abusive, or malicious content. AI-generated suggestions are provided for informational and entertainment purposes only.

6. Location Sharing & Emergency Disclaimer

WhereU facilitates real-time location sharing, event discovery, and social meetup coordination. You maintain full granular control over when, where, and with whom your location is shared (including Ghost Mode and auto-expiring timers).

IMPORTANT: WhereU is NOT an emergency dispatch system, safety monitoring service, or crisis response platform. Never rely on WhereU for personal emergency dispatch. In the event of an emergency, call your national emergency number immediately (112 in the EU, 911 in the US).

7. Intellectual Property & User Content

You retain all ownership rights to the content, photos, and messages you submit to WhereU. You grant WhereU a worldwide, non-exclusive, royalty-free license to host, display, and transmit your content solely as necessary to operate and deliver the Service to your chosen recipients. WhereU logos, trademarks, and interface designs remain the exclusive property of DPA Tech Solutions SRL.

8. Limitation of Liability

To the maximum extent permitted by applicable law, DPA Tech Solutions SRL and its officers, directors, and employees shall not be liable for indirect, incidental, special, or consequential damages, loss of profits, or data loss arising from your use of the Service or offline meetups. Our total aggregate liability is limited to the greater of 100 EUR or the total amount paid by you to WhereU in the twelve months preceding the claim.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of Romania, without regard to conflict of law principles. Any legal dispute shall be resolved by the competent courts of Bucharest, Romania. EU consumers may additionally access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
